Do not use www.melwebdesigns.com or our products and services for your purpose or intent to conduct the following actions. Do not send or post any messages, materials or pictures that are unlawful, harassing, defamatory, abusive, threatening, obscene, sexually orientated, racially oriented, profane and offensive. Do not send or post messages, materials or pictures that violate any applicable laws in any country where www.melwebdesigns.com conducts
business. You hereby indemnify the Company Print and Web Designs Pty(Ltd) trading as MelWebDesigns against any loss, liability, damage or expense of whatever nature which the Company or any third party may suffer and which is caused by or attributable to, whether directly or indirectly, your use of the Site. You also hereby agree to compensate Print and Web Designs Pty(Ltd) trading as MelWebDesigns and all third party entities for any loss, liability, damage,
expenses and negative impact caused directly or indirectly as a result of your use of www.melwebdesigns.com and/or its products/services.

It will not be allowed to use the website www.melwebdesigns.com or any products/services sold by MelWebDesigns to send or post any message or material that is unlawful, harassing, defamatory, abusive, threatening, obscene, sexually orientated, racially offensive, profane or which violates any applicable law and you hereby indemnify the Company against any loss, liability, damage or expense of whatever nature which the Company or any third party may suffer and which is caused by or attributable to, whether directly or indirectly, your use of the Site. 

Intellectual Property
All intellectual property rights, including copyright, in all materials, including trademarks, logos, photographs, images, text and other graphics which form part of the Site www.melwebdesigns.com are owned by Print and Web Designs Pty(Ltd) trading as MelWebDesigns. Such rights are protected by both South African and international intellectual property laws. All data and information communicated to or from the Site and/or any Site information as well as the database is the sole property of the Company. The Company grants you permission to view, electronically copy and print portions of the Site for the sole purpose of placing an order with the Company for any of the Products/Services. Any use of materials on the Site other than for the purpose noted above including, without limitation, the unauthorised submission, removal, modification, dissemination, copying or distribution of copyrighted or other proprietary content, without the prior written consent of the Company and/or the lawful trademark and/or copyright owner (if applicable), is prohibited and constitutes an unlawful infringement of the intellectual property rights of the Company and/or such trademark and/or copyright owner. 

When you use or visit this Site, need to communicate with Mel, get online services or support: only electronic communications will be allowed.  This is to protect Mel and you the client from any miscommunication. Please note that all electronic communication to the Site including, without limitation, e-mails or place orders for Products/Services, you:

    • consent to receiving communications from the Company electronically;
    • agree that all notices, disclosures and other communications sent by the Company, including this Agreement, satisfies any legal requirements, including but not limited, to the requirement that such communications should be ‘in writing’
    • agree that the Company may use your information to contact you about promotions and special offers if you have indicated during registration that you would like to receive such information. You are entitled, at any stage, to opt out of this service. We shall not sell or rent information about you including, without limitation, your name, identity number, address, email address and contact telephone number (“personal information”) to any third parties; and
    • agree that the Company may disclose your personal information in response to a specific request by a law enforcement agency, subpoena, court order, or as otherwise required by law, e.g. for accounting purposes.

Subject to availability, the price for Products/Services will be the price shown on the Quote (if provided and please not the date of Quote Expiry) or on the Invoice (before Due Date provided on the Invoice) provided to you from MelWebDesigns. Special promotions may be subject to certain conditions, including stock availability and limited offer stipulations. Time-based pricing is only available during the times and dates stipulated on the Website/Quote/Email/Invoice.  In the event of a Product being on special, this price will be displayed.  

  • We do not accept artwork in these formats: Word Files, .gif, Power Point.
  • Designs will only commence once full payment for designs has been received.
  • Some products and specials advertised by MelWebDesigns will from time to time include free artwork designs, but this can be changed at any time without prior notice.
  • Designs provided by the client will be used as is, and we take no responsibility for the quality of the desings – unless requested by the client for design upgrade/changes and paid for as per quoted for the hours of work on the design. A quote must first be requested, to make clear if the requirements can be met as by clients’ needs.

An agreement of sale in respect of a Product/Service between the Company and you only comes into effect if and when the Company’s bank statement reflects your payment via EFT. When a payment has been made, the client agrees that he has read, understood and agrees to the Terms and Conditions as laid out on MelWebDesigns’ website link Terms and Conditions – Under Construction. The Company reserves the right to:

    • refuse to accept and/or execute an order without giving any reasons; and
    • cancel orders in whole or in part in its sole and absolute discretion. The Company shall only be liable to refund monies already paid by the user for products/services not delivered.

DESIGNS:

  • Unless specified, graphic design fees are charged per hour.
  • A website design fee includes any design changes required while the website is “Under Construction”, until the day the clients’ website goes live.
  • A clients’ website will not go live until the client has approved the website and given the live go-ahead per email to info@melwebdesigns.com or per whatsapp directly to Mel.
  • Once a website goes live, the client may request website changes per email to info@melwebdesigns.com.  The change request will be reviewed and a quote may or may not apply.  Generally if the web changes require less that an average of 10 minutes work,  Mel will often not charge you for those changes – for example changing a contact number, dates or even a photo.

SUPPORT:

  • Any online or computer support will be invoiced a support fee.  The fee per hour might change per customer, as travel time and urgency might be considered, or the fee might not have been updated here on the website page yet.  
  • A flat rate will be charged and invoiced for the first hour, even if less than one hours work might be required.  This first hours’ fee needs to be paid in advance, before work will commence or an appointment date will be set. After one hours’ work, the remaining fee will be calculated on the exact time spent at premises or online. Time is calculated from arriving at premises/starting work online/logging into clients’ work environment, until leaving the premises/completing the work online/exiting the clients’ work environment.  This remainder fee will then be invoiced to the client and will be due to be paid within 24 hours.
  • Please note any support required needs to be made by appointment in advance. 
  • Any support provided needs to be backed up by electronic communication as specified in the Terms above, under ELECTRONIC COMMUNICATION.

HOSTING AND DOMAINS:

  • Hosting fees are calculated on storage space used on the hosting server, and includes support time for email setup, backups and restore of emails and/or website in case of unforeseen emergency events (not including clients losing their own backups or deleting their own mails), security checks and safety precautions, and general hosting support.
  • Hosting AND Domain fees must be paid at least in one month advance, because MelWebDesigns uses a third party provider for hosting websites and emails.  If hosting and domain fees are not paid to MelWebDesigns in advance, we cannot provide support and we cannot cover your hosting and/or domain fees at the third party provider(s).  Hosting and Domain fees are due by the end of each month and/or the date specified on the invoice. If the renewal fees are not paid on time, a client will be at risk that their entire domain, emails and/or website can be disconnected.  Once their services have been disconnected, it can take a couple of hours to as much as 24 hours for services to resume again.  To have your services connected again, payment has to be made within 7 days of disconnection, and proof of payment must be sent to info@melwebdesigns.com or to Mel per whatsapp.  If payment is not made within 7 days, a late payment fee will apply.  Services that are disconnected for extended periods of time will require extra time and effort for restoration.
  • Once domain/hosting payment has not been made before the due date on the invoice, and 7 days have passed after that – MelWebDesigns cannot guarantee that services for hosting and domain renewals will be successful.  A domain name that has expired cannot be guaranteed to be available again.  Hosting services that have expired cannot be guaranteed of any loss regarding emails.
  • If you would like to cancel an order/product/service, this may be done by emailing the Company on info@melwebdesigns.com or by contacting Mel on +27823145481.
  • You will be able to cancel an order/service at any time, except for hosting and domain renewals which will be paid in an month or year in advance, respectively. No penalty charges will be levied against cancelled orders/services.
  • You may cancel your hosting any time before you pay for the next month in advance, however once payment has been made for a month in advance, that months’ hosting cannot be refunded. If hosting has been pade for more than one month in advance, and you cancel your hosting, only that current month in which you cancel it – the hosting fee will be kept by MelWebDesigns, and the rest of the months will be refunded to you.
  • A domain renewal can be cancelled, but once paid for a year in advance, the monies paid for renewal to a domain cannot be refunded.
  • The Company shall be entitled to retain any payment already received from you in respect of fees/working hours where a Product/Service has already been delivered to you prior to your cancellation of the order, as set out above.
  • Without prejudice to any other rights or remedies in law, the Company shall be entitled to cancel forthwith any sale/product/service and/or your registration if you should breach any of your obligations.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data

This Agreement constitutes the whole agreement between the parties relating to the subject matter hereof. Any indulgence of extension of time granted by the Company to you shall not be construed as a waiver or variation of any of our rights or remedies. At the option of the Company, any dispute arising out of the Agreement may be brought in any Magistrates’ Court of competent jurisdiction notwithstanding that the amount in issue may exceed the jurisdiction of such court. The Site is hosted and managed in the Republic of South Africa and this Agreement is accordingly governed by the laws of the Republic of South Africa. Any dispute of any nature whatsoever arising between the parties on any matter provided for in, or arising out of this Agreement, may be submitted in writing to info@melwebdesigns.com.   Where after a meeting will be arranged with the owner of MelWebDesigns and the client, and is agreed that the meeting will be recorded for confirmation and agreement purposes.  If no meeting is held, MelWebDesigns cannot be held responsible to agree to any terms of the client, if MelWebDesigns is not given a chance to explain the printing, website and designs processes.

MelWebDesigns are a Sabbath & Torah observing business.

This means that Mel, the owner of MelWebDesigns, and all persons & services used by Mel will not be operating during any Sabbath or High Sabbath days.  All other public holidays Mel will still be available, except if they might fall on the following days/hours/dates:

BUSINESS WORKING HOURS: 

Mondays – Thursdays 9:00 – 17:00

Fridays 9:00 – 15:00

NO WORK – HIGH SABBATH DAYS:

*High Sabbath days change each year, and we will each year update these dates accordingly.

MelWebDesigns have been trading since 2017 as a registered company Print and Web Designs (Pty) Ltd, from Gauteng South Africa. Since 2024 Mel has moved away from doing printing services herself, however she can assist and recommend some excellent printing service providers. Today Mels’ main focus is online business services like Website Design, Hosting and Domain Services, Setup of Emails, Basic Graphic Design, Social Media setup and support, Basic Online Training for Small Business Support, some Specialized Services like database support and Basic Computer Support.
Mel can also recommend some other advanced services where required, for example Advanced Graphic Designing.

Where it comes to Website Hosting, Mel does not store the emails and website files and databases herself, but rather uses a third party hosting provider that is of excellent reputation.  When Mel assists you in registering your website and setup the hosting and emails, she will register it in your own (Personal or Company) name, and send you all the contact  and password information for safekeeping – which will be your responsibility to keep as the OWNER of your website domain name and hosting.  You are welcome to contact Mel for any queries regarding this or about the third party provider(s).
